The Case Concerning Legalized Job Scraping

What is it, and why is it allowed?

What is “job scraping?”

Job scraping is the automated process of collecting job postings and related information from online platforms such as job boards, company career pages, and recruitment sites using software tools or scripts.

This is what’s behind job boards with no affiliation to companies listing their jobs.

I was tipped off by a source Lensa should be investigated.

The source said and I quote,

“Good post on Talentify - Check on Lensa (Hungary-based) – 5,000 jobs from their "one of our clients" and they point to several harvesting sites. And all/most of the jobs are being post as "LinkedIn Verified".  I challenged them on their claims, and they virtually hung up on me.”

So, I did some digging.

I came across a role for a “Technical Writer” with the company Codeworks. This is a real company and so is the job. I know because I called them and spoke with an employee who was kind enough to check their internal systems and confirm they have no affiliation with Lensa.

Which prompted my next statement, which I’m paraphrasing, but I said,

“I was concerned because they listed the job on their website, but before I was redirected to apply, I saw a pop-up asking for my email before it took me to the job posting on LinkedIn. Is this a case of job scraping?”

The employee confirmed it is and basically said there’s nothing they can do.

Lensa’s own privacy policy page says,

“We collect data from third parties, such as Facebook, LinkedIn and through other public sources. This is referred to as “Sourcing” and be manually performed by our employees or automatically in the Service.

In some cases, existing employees can make recommendations about potential applicants. Such employees will add personal data about such potential applicants. In the cases where this is made, the potential applicant is considered a User in the context of this Privacy Policy and will be informed about the processing.”

I wondered if job scraping is legal because you would think taking a job you have no affiliation with and listing it would be wrong, but it isn’t.

If a company becomes a go-between and collects your email while directing you to the original posting, where is the exclusivity/benefit of them posting the job?

You gave your email out for no reason.
